Agreement and service scope
1 About these Terms
1.1These Terms of Service govern access to and use of the Ylasore Labs website, user accounts, PropScan credits, checkout, reports and related support services.
1.2In these Terms, "Ylasore Labs", "we", "us" and "our" refer to the trading name used for the PropScan service.
1.3Your order, checkout summary, these Terms, the Privacy Policy and any policy expressly linked at checkout form the contract for that order.
1.4By creating an account, placing an order or using a PropScan credit, you confirm that you have read and agree to these Terms. If you do not agree, do not buy or use the service.
1.5Nothing in these Terms excludes or restricts a right or remedy which applicable law does not allow us to exclude or restrict.
2 Definitions
2.1The following meanings apply throughout these Terms:
3 Eligibility and authority
3.1You must be at least 18 years old and legally capable of entering into a binding contract.
3.2If you use the service for a company, agency, property owner or another person, you confirm that you have authority to act for them and to submit the relevant information.
3.3You must not use the service where doing so would breach applicable law, sanctions, court orders or another binding restriction.
4 PropScan and credits
4.1Each product page states the number of credits included, the current price and the principal features of the service.
4.2Unless the product description says otherwise, one credit is consumed when you submit an eligible listing for report generation.
4.3A credit is associated with the purchasing account. It is not a stored-value account, currency, investment, deposit or transferable payment instrument.
4.4We may refuse or pause a submission which is technically inaccessible, clearly invalid, abusive, unlawful or outside the stated scope of PropScan.
5 Nature and limits of the service
5.1PropScan uses automated processes to analyse available property-listing information and produce observations, scores, flags or suggestions intended to support the user's own review.
5.2PropScan is not an estate agent, broker, surveyor, valuer, lawyer, financial adviser, tax adviser, engineer, architect or regulated property professional.
5.3A Report is not a valuation, survey, legal opinion, investment recommendation, market appraisal, title check, compliance certificate or instruction to enter or reject a transaction.
5.4The service does not contact buyers, market a property, manage a listing, negotiate a sale or complete any transaction for the user.
Part B
Reports and user responsibilities
6 No guarantee of results
6.1Property outcomes depend on many factors outside our control, including price, condition, location, presentation, demand, competition, platform algorithms, buyer behaviour, finance, legal checks and market conditions.
6.2We do not guarantee that following any observation or suggestion will produce a sale, enquiry, viewing, offer, price increase, ranking improvement, faster transaction or any other result.
6.3We do not guarantee that every issue affecting a listing will be detected, that every suggestion will be suitable for the user's circumstances, or that third-party platforms will accept or preserve any change.
6.4A Report is a snapshot based on the information available at the time it is generated. Later changes to the listing, market or third-party services are not automatically reflected.
7 Your responsibility for decisions
7.1You must use your own judgement before relying on, publishing or acting on any part of a Report.
7.2You are responsible for checking factual statements, measurements, pricing, ownership, permissions, legal disclosures, energy information and all other material property details.
7.3You should obtain appropriate independent professional advice where a decision involves legal, tax, financial, structural, safety, valuation or regulatory matters.
7.4You are solely responsible for deciding whether and how to implement a suggestion and for reviewing the final content before it is published or supplied to another person.
8 Listing access and third-party data
8.1You must provide a valid, accessible listing URL or the information requested by the service.
8.2Analysis may be limited by login walls, consent screens, anti-bot measures, geographic restrictions, temporary outages, page changes, missing data, inaccessible media or restrictions imposed by a third-party website.
8.3We are not responsible for the accuracy, completeness, legality, availability or continued accessibility of content supplied by the user or a third party.
8.4References to third-party platforms do not imply endorsement, partnership or control.
9 Information and materials you submit
9.1You confirm that you are entitled to submit the listing, URL, text, images and other materials provided to the service and that our processing of them for the requested service will not violate another person's rights.
9.2You must not submit confidential information, special-category personal data, payment-card details or unrelated personal data through a listing field or support request.
9.3You are responsible for the completeness and accuracy of the information you provide. Incomplete, outdated or incorrect inputs may produce incomplete or incorrect output.
10 Account security
10.1You must provide accurate account information and keep your email address current.
10.2You are responsible for safeguarding your password and for activity performed through your account, except to the extent caused by our failure to apply reasonable security measures.
10.3Tell us promptly at hello@ylasore.com if you suspect unauthorised access or misuse.
11 Report delivery problems and corrections
11.1If a technical error prevents a paid Report from being generated or delivered, contact us with the account email, listing URL and relevant details.
11.2After verification, we may restore the affected credit, regenerate the Report, correct a technical defect or provide another remedy required by applicable law.
11.3A disagreement with an observation, score or suggestion is not by itself evidence that the service failed, because the Report is analytical and does not guarantee outcomes.
11.4You should report a suspected technical problem promptly so that logs and source material can be reviewed while available.
Part C
Credits, payment and delivery
12 Prices, taxes and payment
12.1The checkout displays the total price, currency and applicable taxes before you place an order.
12.2Payments are processed by the payment methods and providers offered at checkout. Their separate terms and privacy practices may also apply.
12.3An order is accepted when payment is confirmed and the order confirmation is issued, unless we notify you of a clear pricing, availability, fraud or technical error.
12.4We may change future prices or packages. A change does not alter an order already accepted.
13 Credit validity
13.1Purchased PropScan credits remain available in the purchasing account until used, unless specific promotional terms shown before purchase state otherwise.
13.2Promotional, replacement or goodwill credits may carry the conditions or expiry period stated when they are issued.
13.3Credits have no cash value and cannot be sold, transferred or exchanged. Any refund rights for unused paid credits remain subject to these Terms and mandatory law.
14 Digital delivery and withdrawal rights
14.1Credits are supplied electronically after successful payment. Report generation begins when you choose to use a credit and submit an eligible listing for analysis.
14.2Any statutory cancellation or withdrawal right available to you remains unaffected by these Terms.
14.3By choosing to use a credit and submitting a listing for immediate analysis, you request immediate personalised performance. Any loss of a statutory withdrawal right applies only where the law permits and all legally required information, consent, acknowledgement and confirmation have been provided.
14.4The order record identifies the acceptance date and the Terms page linked at checkout.
15 Refunds
15.1Nothing in this section limits a refund, cancellation, withdrawal or other remedy required by mandatory law.
15.2Subject to mandatory law, a credit which has been used and for which Report generation has begun is not refundable merely because you change your mind, disagree with the analysis or do not obtain the property outcome you wanted.
15.3Verified technical failures are handled under section 11. Duplicate or unauthorised payments should be reported promptly.
15.4Before starting a payment dispute or chargeback, please contact us so that we can investigate. This does not remove any right to contact your payment provider.
16 Delivery, downloads and retention
16.1Reports and account records are normally made available through your dashboard or another delivery method described by the service.
16.2Generation and delivery times are estimates, not guarantees. Complex listings, third-party restrictions, maintenance or exceptional demand may cause delay.
16.3You should download and securely retain any Report you wish to keep. We do not promise permanent hosting or indefinite access to historical Reports unless expressly stated.
Part D
Permitted use and platform operation
17 Permitted use
17.1Subject to these Terms, you may use a Report for your own internal, personal or business decision-making in relation to the analysed listing.
17.2You may share a Report with your professional advisers, employees, contractors or property representatives where reasonably necessary, provided they respect its confidential and limited-purpose nature.
17.3You must not present a Report as a professional valuation, survey, legal certificate, official platform audit or guarantee from Ylasore Labs.
18 Prohibited use
18.1You must not:
- use the service for unlawful, fraudulent, deceptive, abusive or discriminatory activity;
- submit material you do not have the right to use;
- attempt to bypass payment, credit, access-control or security mechanisms;
- interfere with, overload, scrape, probe or reverse engineer the service except where applicable law expressly permits it;
- use automated means to create accounts, submit requests or extract content without written permission;
- resell, white-label, publish or commercially distribute a Report as your own product without written permission;
- use the service or its output to build, train or improve a competing model, dataset or service without written permission; or
- misrepresent the source, status, certainty or purpose of a Report.
19 Intellectual property
19.1The website, software, analysis methods, templates, design, branding and service content are owned by or licensed to Ylasore Labs and are protected by applicable intellectual-property laws.
19.2You retain ownership of materials you submit. You grant us a limited right to host, copy, process and analyse those materials only as reasonably necessary to provide, secure and improve the service, comply with law and resolve support issues.
19.3After full payment, you receive a limited, non-exclusive, non-transferable licence to use the delivered Report as permitted by section 17.
19.4No ownership in our service, methodology, software or branding transfers to you.
20 Privacy and data use
20.1We process personal data to operate accounts, accept payment, deliver services, prevent misuse, provide support and meet legal obligations.
20.2Payment providers, hosting providers, email providers, analytics services and other processors may handle relevant data in order to provide their functions.
20.3Please read the Ylasore Labs Privacy Policy for more information about how personal data is handled and how to exercise applicable rights.
20.4You must not submit another person's personal data unless you have a lawful basis and authority to do so.
21 Availability and changes to the service
21.1We aim to provide a reliable service but do not promise uninterrupted, error-free or permanently available operation.
21.2We may maintain, secure, update, replace or discontinue features where reasonably necessary. We will take reasonable steps to avoid unfairly removing the value of paid, unused credits.
21.3We are not responsible for delay or failure caused by events outside our reasonable control, including internet outages, third-party platform changes, payment-provider failures, cyber incidents, public-authority action or natural events.
22 Suspension and termination
22.1We may suspend or restrict access where reasonably necessary to investigate fraud, protect users or systems, comply with law, address non-payment or stop a material breach of these Terms.
22.2Where appropriate, we will give notice and a reasonable opportunity to remedy the issue before termination, unless urgent action is required.
22.3You may stop using the service at any time. Account closure does not automatically create a refund right, but mandatory rights and valid existing claims remain unaffected.
Part E
Risk, liability and disputes
23 Service disclaimers
23.1To the fullest extent permitted by law, the service and Reports are supplied on an "as available" basis and may contain omissions, limitations or errors arising from automated analysis, source material or third-party access.
23.2We do not make any promise about the accuracy, completeness, currency, suitability or commercial value of a Report beyond any promise which applicable law requires or which we expressly state in writing.
23.3No statement in marketing material, a sample Report, support response or website article creates a guarantee of sale or another property outcome unless expressly included in your order.
24 Limitation of liability
24.1Nothing in these Terms excludes or limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, deliberate wrongdoing, or any other liability which cannot lawfully be excluded or limited.
24.2Subject to clause 24.1 and to the fullest extent permitted by law, we are not liable for indirect, incidental, special or consequential loss, or for loss of profit, revenue, opportunity, anticipated saving, goodwill, data, a buyer, a sale, a transaction or an expected selling price.
24.3Subject to clause 24.1, we are not liable for a user decision, listing change, omission or transaction made in reliance on a Report, or for the acts, data, availability or decisions of a property platform, buyer, seller, agent, adviser, payment provider or other third party.
24.4Where the user acts wholly or mainly for business purposes, and subject to clause 24.1, our total aggregate liability arising from the affected order will not exceed the amount paid for that order.
24.5Where the user is a consumer, any limitation in these Terms applies only to the extent it is fair, transparent and permitted by applicable mandatory consumer law.
24.6You are responsible for taking reasonable steps to avoid or reduce loss, including checking important information and seeking professional advice where appropriate.
25 Third-party services and links
25.1The service may rely on or link to third-party websites, payment methods, listing platforms and software. We do not control their content, terms, security, uptime or decisions.
25.2Your use of a third-party service is governed by that provider's own terms. A link or technical integration is not a guarantee or endorsement.
26 Business-user indemnity
26.1If you use the service wholly or mainly for business purposes, you will compensate Ylasore Labs for reasonable losses, costs and claims caused by your unlawful use of the service, material breach of these Terms or infringement of another person's rights.
26.2This section does not apply to a consumer acting wholly or mainly outside their trade, business, craft or profession.
27 Complaints and support
27.1To raise a complaint or request support, email hello@ylasore.com with your account email, order number and a clear description of the issue.
27.2We will acknowledge and review complaints within a reasonable period and may request information reasonably needed to investigate.
27.3Any statutory right to use a court, regulator, consumer body or approved dispute-resolution process remains unaffected.
28 Governing law and courts
28.1These Terms are governed by the laws which apply to the contract under mandatory conflict-of-law rules.
28.2Nothing in these Terms removes any mandatory consumer protection available in the user's country of residence where the service directs sales to that country.
28.3The courts with jurisdiction under applicable law may hear a dispute. The parties should first make a reasonable attempt to resolve the issue through the complaints process in section 27.
29 Changes to these Terms
29.1We may update these Terms to reflect changes in the service, law, security requirements or business operations.
29.2The version and effective date appear at the top of this page. The Terms accepted at checkout apply to that order unless a later change is required by law or expressly agreed.
29.3If a material change affects existing paid services, we will take reasonable steps to give notice before it takes effect.
30 General terms
30.1If any provision is held invalid or unenforceable, the remaining provisions continue in effect and the affected provision will apply only to the maximum extent lawful.
30.2A delay in enforcing a right is not a waiver of that right.
30.3You may not transfer your contract or credits without our written consent. We may transfer the contract as part of a genuine reorganisation, financing or sale of the service, provided this does not reduce mandatory consumer rights.
30.4These Terms do not give enforcement rights to a person who is not a party to the contract, except where applicable law provides otherwise.
30.5Electronic notices may be sent to the email address associated with your account. You are responsible for keeping it current.
